REGULATION OF THE SUPPLEMENTARY BENEFITS OF THE NATIONAL HEALTH SERVICE AND OF THE SUBSIDIES FOR PROFESSIONAL AND EXTRA PROFESSIONAL ACCIDENTS.
This regulation regulates the health services provided by the E.Bi.Conf. through the agreement stipulated with the General Mutual Relief Society "Mutua Basis Assistance" (hereafter called MBA).
The Regulation consists of two parts:
1. GENERAL PART:
ACCESS TO HEALTH BENEFITS AND ACCIDENT AID:
Effective dates and subjects who can take advantage of the convention for health services, for professional and extra-professional accidents, due to the payments made by Employers who apply the aforementioned CCNL.
2. SPECIAL SECTION:
The regulations of the subsidies provided by the Mutual MBA.
HEALTH BENEFITS AND ACCIDENT AID
1. TO WHICH EMPLOYEES THE CONVENTION APPLIES.
The Convention relating to health services in place with the mutual MBA regards only Employees hired on permanent contracts or apprenticeships (or for a fixed term of more than 12 months), full time or part time equal to or greater than 16 average weekly hours, for which the contribution envisaged by the CCNL in force or by subsequent agreements between the stipulating Parties is paid.
2. COMPANY AND EMPLOYEE REGISTRATION OBLIGATION
Employers have an obligation, deriving from the CCNL referred to in the introduction, to enroll in the E.Bi.Conf. both the Company and the employees from the moment of its application, observing the following methods:
• Payment via F24 and completion of the UNIEMENS procedure following the indications of the Revenue Agency Resolution of 20 October 2016 n. 97 / E which is followed by the INPS Circular no. 201/2017 relating to the agreement with the E.Bi.Conf., Available in the "documents" section of the body's website.
N.B. By observing this procedure, the Entity will be able to acquire the personal data of employees entitled to health coverage, as well as all information relating to any extensions, transformations, terminations and new hires.
Therefore, no further communications from the company or the Consultant will be necessary.
3. EXPECTED CONTRIBUTION
At the time of the first payment, together with the payment of contributions, the Company must register:
1. to the employer body Co.N.A.P.I. paying only an annual fee of € 140.00 as nothing is due for employee registration, by downloading the relevant model from the website www.ebiconf.it in the "Membership" section;
2. to E.Bi.Conf. for free, by downloading the relevant model from the website www.ebiconf.it in the "Membership" section.
4. EFFECT OF THE CONVENTION FOR INDIVIDUAL EMPLOYEES REGULARLY REGISTERED
The registration of the Employee by the Employer, in the manner referred to in point 2, and the payment of the contribution envisaged by the CCNL constitute the prerequisite for the Employee's right to benefit. The entitlement to health care benefits matures after 90 days from the first payment of the contribution by the employer, while the benefit for professional and extra-professional accidents matures after 180 days from the first payment.
N.B. "Date of the first payment" is conventionally understood as the one expected for the expiry of the F24, reported in point 5 below.
Example for health service:
for a first payment made on 4 June, the "payment date" will be 16 June, with the start of health coverage from 16 September.
Example for injury:
for a first payment made on 4 June, the "payment date" will be 16 June, with the start of accident coverage from 16 December.
5. CONTINUITY OF PAYMENT OF CONTRIBUTIONS AND SUSPENSION OF THE SUBSIDY
Once the first payment has been made, the employer is required to pay the monthly contributions by the 16th of each month, for the skills of the previous month.
(Ex: the company that applies the CCNL from January will make the first payment by February 16)
IF THE EMPLOYEE'S RECRUITMENT OCCURS AFTER DAY 15 OF THE MONTH, THE CONTRIBUTION WILL BE DUE TO THE MONTH FOLLOWING THE RECRUITMENT.
Example: for an employee hired on January 16, there is an obligation to pay from February and will be paid by March 16.
IF THE EMPLOYEE'S TERMINATION HAPPENS BEFORE DAY 15 OF THE MONTH, THE CONTRIBUTION WILL NOT BE DUE.
N.B. In the event of failure to pay within the terms, the benefit in favor of the employee will be suspended with immediate effect. The company will have to take care of the provision of all the subsidies provided for eligible employees.
6. DISCLAIMER E.Bi.Conf. FOR DECADENCE OR TERMINATION OF AGREEMENT
In the event of the forfeiture or termination of the Agreement for any reason, the members may request, as of the termination of the same, only the subsidies that will be approved as a replacement by the E.Bi.Conf.
7. VOLUNTARY CONTINUATION OF THE CONVENTION
In the event of a layoff, suspension of the employment relationship or application of another CCNL for which the Employer has no obligation to pay, the registered employee can decide to voluntarily maintain their health coverage, by contacting directly to the bilateral body.
